⚠️ 重大法律变化:Section 21 已废除(自 2026 年 5 月 1 日起)

根据 Renters’ Rights Act 2025,自 2026 年 5 月 1 日起,私人房东不能再发出 Section 21 通知。如您此后收到驱逐通知,实际上是 Section 8 — 请参考我们的 Section 8 应对指南

本文适用于:2026 年 5 月 1 日前已发出的 Section 21 通知仍在法律程序中的情况。


Section 21 通知的法定要求(Housing Act 1988 s.21)

如通知在 2026 年 5 月 1 日之前发出,必须满足以下所有条件才有效:

Defence to Accelerated Possession Claim (Section 21, Housing Act 1988)

I am the Defendant in these proceedings. I oppose the Claimant’s application for a possession order on the following grounds:

Ground 1 — Deposit not protected in accordance with Housing Act 2004 s.213
The Claimant failed to protect my tenancy deposit in a government-authorised Tenancy Deposit Protection scheme and/or failed to provide the prescribed information required under s.213(5) of the Housing Act 2004 and the Housing (Tenancy Deposits) (Prescribed Information) Order 2007 (SI 2007/797). By virtue of s.215(1) of the Housing Act 2004, no Section 21 notice may be given while this requirement remains unsatisfied.

Ground 2 — Gas Safety certificate not provided (SI 2015/1646)
The Claimant failed to provide a valid Gas Safety certificate before the commencement of the tenancy and/or failed to provide a copy at each subsequent annual inspection, in breach of Regulation 3(1)(b) of the Assured Shorthold Tenancy Notices and Prescribed Requirements (England) Regulations 2015 (SI 2015/1646) read together with the Gas Safety (Installation and Use) Regulations 1998. This failure renders the Section 21 notice invalid per Caridon Property Ltd v Monty Schooltz [2018].

Ground 3 — Retaliatory eviction contrary to Deregulation Act 2015 s.33 (include if applicable)
On [date], I made a written complaint to the Claimant regarding the following disrepair/housing conditions at the property: [brief description]. On [date], the local housing authority issued an Improvement Notice under Part 1 of the Housing Act 2004. Pursuant to s.33(2) of the Deregulation Act 2015, a Section 21 notice served within six months of the Improvement Notice is of no effect. The notice served by the Claimant falls within this prohibited period and is therefore invalid.

Relief sought
For the reasons set out above, I respectfully request that the Court:
(a) decline to make a possession order; and
(b) dismiss the Claimant’s application.

报复性驱逐保护(Deregulation Act 2015 s.33)

如您曾书面投诉房屋问题且 Council 已发出 Improvement Notice,房东在以下期间不能发 Section 21:

  • Improvement Notice 发出后 6 个月内(DA 2015 s.33(2))
  • Emergency Remedial Action 发出后 6 个月内(DA 2015 s.33(3))
